Terms of Service
Last updated: 21 October 2026
Please read these terms before you use the service. We have kept them plain.
1. Who we are and what these terms cover
DineNDash (“the service”, “we”, “us”) is operated by [FULL NAME], an individual based in India, at [ADDRESS]. You can reach us at [EMAIL].
The service is software for cafés: customers scan a QR code, order and pay, and staff see orders on a kitchen screen. These terms are an agreement between you (the café owner who creates an account) and us. By creating an account or using the service you accept them.
Your customers who order from your café are not parties to this agreement. How their data is handled is explained in our Privacy Policy.
2. Your account
- You must be at least 18 and able to enter a binding contract, and you must have the authority to act for the café you register.
- Give accurate details and keep them current. Use a permanent email address.
- You are responsible for everything done through your account, including by staff you invite. Keep passwords safe and remove staff who should no longer have access.
- The account owner is the only person who can change billing.
3. Free trial
New cafés get a free trial, 14 days by default, with no card needed. The length shown at sign-up is the one that applies to you. When the trial ends, your café needs a paid plan to keep taking orders. If you do not subscribe, ordering pauses, and you can subscribe at any time to resume.
4. Plans, fees and payment
- Plans, prices and what each plan includes are shown on our pricing page and may change. A price change applies to new subscriptions and to renewals after we have told you; it does not change a period you have already paid for.
- Plans are billed monthly or yearly in advance in Indian rupees. GST is added where it applies.
- Payment is by recurring mandate (UPI AutoPay, card or e-mandate) set up through our payment providers, Razorpay or Cashfree. We never see or store your full card or UPI details.
- If a payment fails, you get a grace period of 7 days to fix it. If it is not fixed, your café is paused (customers cannot order) until payment succeeds.
- Switching to a higher plan takes effect straight away. Switching to a lower plan takes effect at the end of the period you have paid for.
- Cancellation and refunds are covered in our Refund & Cancellation Policy, which forms part of these terms.
5. Money your customers pay you
If you take online payments from customers, those payments go through your own Razorpay or Cashfree account, not ours. We do not hold your customers’ money. You are responsible for your agreement with the payment provider, for the prices and taxes on your menu, and for refunds to your customers. The service calculates totals on our servers from the prices you set; you are responsible for keeping those prices correct.
6. Payment gateway keys
To take online payments you connect your own payment gateway account (Razorpay or Cashfree) by saving its API keys in the console. You confirm with a tick box each time you save new keys.
- DineNDash is not a payment aggregator and never holds your money. Customers’ payments go straight to your gateway account.
- We store your keys encrypted and use them only for your café’s payments: to create them, verify them and issue refunds. We never share or sell them.
- You can remove your keys at any time from the console, and we delete them.
- You are responsible for your gateway account, including its KYC, refunds, chargebacks, taxes and disputes with customers or the gateway.
- If you think your keys have been exposed, rotate them with your gateway straight away and save the new ones here.
- We are not liable for gateway outages, account suspensions or holds by the gateway, or losses caused by keys leaked outside our systems.
7. Your content and data
You own your menu, photos, prices and order records (“your content”). You give us permission to store, process and display it only as needed to run the service for you.
For personal data of your customers, you decide why and how it is collected and we process it on your behalf, as described in the Privacy Policy. You must have the right to upload what you upload and must not upload anything unlawful or that infringes someone else’s rights.
8. Acceptable use
Do not use the service to:
- break the law or sell anything illegal;
- send spam or messages people have not asked for;
- attempt to access other cafés’ data, probe or disrupt the platform, or bypass limits and security;
- resell or white-label the service without our written agreement.
We may pause or close a café that breaks these rules or puts customers or the platform at risk, after telling you where we reasonably can.
9. Availability and changes
We work to keep the service running but cannot promise it will be uninterrupted or error-free. It depends on third parties such as hosting, messaging and payment providers. Keep a fallback (for example, a way to take orders by hand) for busy hours. We may improve, change or retire features; if we remove something material from your plan we will give notice.
10. Ending the agreement
You can cancel any time from the billing page. What happens to your café and your data afterwards is set out in the Refund & Cancellation Policy and the Privacy Policy. In short, your café is closed at the end of the paid period and its data is deleted 90 days after cancellation, except invoices and records we must keep for tax.
We may end or suspend your account for serious or repeated breach of these terms.
11. Warranty and liability
The service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential loss, such as lost sales or profits, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose. Nothing here limits liability that cannot be limited by law.
12. Governing law and disputes
These terms are governed by the laws of India. Courts at [CITY] have exclusive jurisdiction, subject to any rights you have under consumer or other law. Please write to us at [EMAIL] first; most issues can be sorted out directly.
13. Changes to these terms
We may update these terms. If a change is material we will email the account owner or show a notice in the console before it applies. Continuing to use the service after that means you accept the updated terms. The date at the top shows when they were last changed.
14. Contact
Questions about these terms: [EMAIL], or write to [FULL NAME], [ADDRESS].
